Terms of Service
INKYTHULHU'S TERMS OF SERVICE (TOS):SECTION 1: Copyrights and Use1) You may not copy, trace, edit, sell, redistribute, commercially print, commercially reproduce any works I create, whether or not they are commissioned for you.
--1a) If you desire commercial rights to any art I create, additional fees will be involved.
--1b) My work is NEVER to be used with crypto, NTFs, or genAI, including using AI to 'finish', 'polish', 'edit', or 'color' my work.
--1c) You MAY use commission works done FOR YOU for your own personal icons, banners, etc so long as my signature remains intact and I am credited.
--1d) I will not remove my signature from any artwork I sell. Commissioners will gain an non-watermarked version that retains my signature for their own personal use, and I request they do not post non-watermarked versions online (ex, to twitter, bsky, etc)2) Any finished commissions I make for you, the commissioner, are yours to own. You may repost them online, so long as you include credit and links back to me.
--2a) Do NOT repost any work of mine anywhere online without my watermarks clearly visible on them.
--2b) Do not resell works I've made for you if you happen to sell the OC in them. You may not sell my work for profit. (ex, selling an OC with art included, so charging the price of all the art totaled for that OC. You are not allowed to factor my art in that price tag.)SECTION 2: Payment1) Payments should all be done through Ko-fi. I do not accept other payment methods at this current time.2) Payments must be made either partially or in full upfront. If you cannot afford to pay even partially upfront, then wait until you are secure enough monetarily to request a commission.
--2a) For transparency's sake, this is to make sure I get paid for my work even if my commissioner ghosts me. I accept partial payments specifically for those that are afraid of me ghosting them. I understand commissions are built on mutual trust and respect.3) Payment should be made when I start work. I will inform you when I begin work on your commission.4) IF YOUR COMMISSION IS NSFW IN NATURE, DO NOT MAKE ANY MENTION OF NSFW ANYTHING IN PAYMENT NOTES OR COMMENTS.SECTION 3: Process1) Upon requesting a commission, please have a full reference of the character you desire to be drawn, as well as any surplus references you want to bring to help me get an idea of what you want.
--1a) I do not accept written descriptions, as while helpful, they are not enough for minute details.
--1b) References may include; art done by other artists (as long as its your character in the image), in-game screenshots, stick figure doodles in MSPaint, moodboards, free use photography.
--1c) Do NOT send me genAI images as reference. Do not link me to pintrest.
--1d) If your character has intricate details (tattoos, piercings, specific markings, armor, etc), I require detailed, image reference of each detail.2) You may request progress screenshots at any time, though I will generally provide updates as I work on your commission.
--2a) Please keep an open channel of communication for me while commissioning me, in case I have any questions about the art I'm working on. I will check to see if certain details or poses look alright with my commissioner!3) Once the commission is complete, I will send you a watermarked version of the art, and a non-watermarked version of the art. The watermarked version is for posting publicly, while the non-watermarked version is for private uses.
--3a)Posting my non-watermarked art publicly is prohibited. It is to deter would be thieves.
--3b) All version I send you will have my signature on them. This will not be removed.SECTION 4: What I Will, and Will Not Draw1) I will never intentionally create art that emotionally or mentally harms any minority group.
--1a) If I should create something that is broadly deemed 'offensive', I will gladly accept constructive criticism on the piece and will work to improve both it and myself.
--1b) I reserve the right to reject a commission that I feel contains offensive materials or imagery.
--1c) Do NOT use my art to promote harmful or offensive ideals or messages.2) I will not draw commissions in any style but my own.
--2a) No, not even for a meme. I will not recreate another artists style for money.3) I reserve the right to charge extra money for intricate details, complex characters/armors, additional characters/pets/mounts, or difficult/complex backgrounds.
--3a) I will do romantic art, including OCxCanon.
--3b) I will not do shipping art of any canon, fanon, or headcanon ships for any TV show, movie, comic, etc.
--3c) I will not do shipping/couples art for a third party's OC without the permission of that third party.4) I will potentially draw NSFW, though I reserve the right to charge more for it. (This include nudity, smut, gore, etc.)
--4a) I will not draw NSFW art of real life people/actors, minors, vtubers, youtube personalities, lolicon/shotacon, or animals (bestiality/animal cruelty).
--4b) I will not draw NSFW of other people's OCs without their explicit permission.5) I reserve the right to reject drawing a commission that makes me uncomfortable in any way, for any reason.SECTION 5: Places I Post To1) I currently will post art to FurAffinity, Bluesky, Ko-Fi (non-NSFW), Cara, and Picarto.
--1a) Any art of mine posted to any website not listed above should be reported for art theft and I would like to be informed and linked to it so I may report it. Please do not harass anyone caught reposting, JUST REPORT IT, AND MOVE ON.
--1b) People who have commissioned art from me have the right to post the WATERMARKED version of the art they receive from me onto public websites, so long as they link credit back to me. Please do not report these people.2) I reserve the right to post all commissioned works to my public profiles. If you do not wish for your commission to be public or on certain websites, you MUST clearly state so to me.SECTION 6: Regarding my own OCs/Sonas1) Do NOT create any NSFW art, writing, or other media of my OCs or Sonas without my express permission.
--1a) Do not commission NSFW (or art in general) of my OCs or Sonas from other artists without my express permission.2) I will not make romantic or ship art of my Sonas.
--2a) I may make romantic/ship/NSFW art of my OCs, however.
