Terms of Service
INKYTHULHU'S TERMS OF SERVICE (TOS):1) You may not copy, redistribute, trace, sell, commercially print/reproduce, or edit any works I create, whether they are made for you or not.
1a) Do NOT edit out my watermark(s).
1b) Do NOT use my work for NTFs, crypto, or AI, including AI training or so-called "finishing touches".
1c) You MAY use commissioned work done FOR YOU for personal icons, banners, etc as long as my watermark remains and you give and link credits back to me. If the work was NOT done specifically FOR YOU, you may NOT use it at all.
1d) You may NOT resell any commission I've done for you, even if you sell the featured character. If you give away the character and wish for the new owner to also have the art associated with them, contact me so that I may inform the new owner of my ToS.2) Any finished commission I make for you, you own. You are allowed to repost it to personal and private collections *(such as toy.house) *WITH CREDIT AND LINKS BACK TO ME.
2a) Do NOT repost any work of mine, commissioned or not, to public websites (twitter, FA, dA, r34, etc).
2b) Do NOT use works done for you to then create an NFT.3) I will never intentionally create art that emotionally or mentally harms a minority group. Any art that is credited to me that would do so is not mine, and is the work of a scammer or troll.
3a) If I should create something that is broadly deemed 'offensive', I will gladly accept constructive criticism on the piece and will work to improve both it and myself.
3b) I reserve the right to reject a commission that I feel contains offensive materials or imagery.
3c) Do NOT use my art to promote harmful or offensive ideals or messages.4) Payment for my work must be paid for upfront in either a partial payment or full payment. I will gladly accept partial payments so long as the full amount is paid by the time the commission is finished.
4a) I currently accept payments through paypal and Ko-fi.5) You may request progress sketches at any time, though I will generally show progress shots to my commissioner(s) as I work.6) Reference materials must be provided by the commissioner, be they screenshots, stick figure doodles, moodboards, or ref sheets done by other artists. Written descriptions, while marginally helpful, are NOT enough. Do NOT send me AI images as reference.
6a) Do not link me to pinterest.
6b) Do NOT use the copyrighted works of another artist as reference, unless said picture was commissioned by you, for you.
6c) If your character has tattoos, piercings, or other intricate markings, I will required a detailed reference of them.7) As an artist, I reserve the right to post all commissioned work to my public profiles. If you do not wish for your commission to be public or on certain websites, you MUST clearly state so to me.
7a) I currently only post works to FurAffinity, Picarto, Ko-fi, and Bluesky.
7b) Any art of mine posted to any website not listed above should be reported for art theft and I would like to be informed and linked to it so I may report it. Please do not harass anyone caught reposting, JUST REPORT IT, AND MOVE ON.8) I will not draw commissions in any style but my own.9) I reserve the right to charge extra for multiple characters, complex armors, complex character designs, and complex backgrounds.
9a) I will do couples, including OCxCanon art.
9b) I will not do shipping art for shows, movies, comics, etc.
9c) I will not do art of a third party's OC without permission from that artist.10) I will do N//S//F//W art (tasteful nudity, smut, gore, etc).
10a) This includes OCxCanon. This does NOT include shipping art, I will not draw shipping art.
10b) I will NOT draw N//S//F//W art of other artists OCs without their explicit permission to do so.
10c) I will not draw N//S//F//W art of real life people, minors, vtubers, youtube personalities, lolicon/shotacon, or animals (bestiality/animal cruelty).
10d) I reserve the right to reject drawing a commission that makes me feel uncomfortable in any way.11) Do not create or commission N//S//F//W art/writing/etc of ANY of my original characters (OCs) or Sonas without my express permission.
11a) Do not create or commission ship art/writing/etc of my OCs/Sonas, especially without my permission.12) DO NOT mention anything even REMOTELY N//S//F//W in paypal or Ko-fi when commissioning from me. Doing so can and will get my account in trouble, if not banned. Don't be the one bad apple that spoils the bunch.
